Terms and Conditions

Tour Guide Chain ("Platform") is a specialized management and scheduling software solution engineered to coordinate itineraries, dispatch, assign, and manage guiding jobs between Travel Partners and Tour Guides.

Partner

Travel agencies, tour operators, or destination management companies (DMCs) utilizing the Platform to create, assign, and track Jobs.

Tour Guide (User/Guide)

Licensed professionals or registered individuals using the Platform to manage availability calendars, accept job assignments, and execute assigned tasks.

Job

A specific tour assignment or guiding task published on the Platform containing detailed itinerary dates, language requirements, operational scopes, and agreed compensation.

Information Accuracy

Both Partners and Tour Guides must supply valid, authentic, and up-to-date credentials, including corporate registration details or valid tour guide licenses.

Account Security

Users remain fully accountable for maintaining the confidentiality of their credentials and all operations carried out under their accounts.

Account Suspension

Tour Guide Chain reserves the right to restrict or terminate access if fraudulent profile information or operational breaches are detected.

Job Publishing

Partners are solely responsible for ensuring the accuracy, legality, and operational feasibility of all published Job parameters and compensation terms.

Calendar Integrity & Job Acceptance

Tour Guides are required to maintain accurate calendar availability. Once a Job is accepted and officially confirmed by the Partner, the Guide is bound to execute the full operational scope.

Cancellation Policy

Any cancellation by either party must comply with the designated notice windows stated within the Job or agreed service protocols. Unauthorized cancellations will adversely affect account rating metrics.

Independent Platform Role

Tour Guide Chain functions purely as a technology coordination infrastructure and is not a direct employer of the Tour Guides, unless otherwise established by a separate contractual agreement.

Payment Settlements

Financial transactions, remuneration disbursements, and on-tour expense reconciliations are handled directly between Partners and Tour Guides according to their bilateral contracts.

Independent Platform Role (Tour Chain)

Tour Chain (including Tour Guide Chain) operates solely as a technological and management coordination platform. Tour Chain is strictly not a party to any commercial, employment, or service contract between the Travel Partner (Tour Operator/Agency) and the Tour Guide, nor is it a direct employer of the Tour Guide.

Remuneration and Expense Disclaimer

Tour Chain has no involvement in, control over, or responsibility for negotiating, collecting, withholding, guaranteeing, or disbursing any tour fees, guide remuneration, allowances, per diem, overtime compensation, tips, or on-tour operating expenses. All financial settlements and reconciliations must be resolved directly between the Partner and the Tour Guide.

Dispute Indemnification

Tour Chain explicitly disclaims all liabilities, claims, losses, or legal disputes arising from delayed payments, non-payment, incorrect fee calculations, or financial disagreements between the Partner and the Tour Guide. Both parties agree to defend, indemnify, and hold Tour Chain harmless from any associated claims or damages.

All proprietary code, user interfaces, branding, and platform architecture are the exclusive intellectual property of Tour Guide Chain.

Operational scheduling logs, communications, and user records are maintained and secured in compliance with the Platform's Data Privacy Policy.

Tour Guide Chain is not liable for on-site tour disruptions, interpersonal disputes, service quality variations, or force majeure events arising during physical tour operations.

While striving for uninterrupted platform uptime, Tour Guide Chain disclaims liability for transient technical downtime caused by third-party hosting, network failures, or system updates.

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.

Any dispute arising out of or related to these Terms that cannot be resolved through amicable negotiation shall be submitted to the competent courts of Vietnam.
